CONTRACT AND DELIVERY CONDITIONS

These General Conditions of Contract manage the purchase of products through the website https://estrelladecastilla.es; hereinafter, "the website" or "ESTRELLA". By accepting these General Conditions of Contract, the user declares:

  • That he/ she has read and understood what is stated here.
  • That he/ she is a person with sufficient capacity to contract.
  • That he/she assumes all the obligations set forth herein.
  • That he/she is of legal age (18 years) to purchase the products that are offered in the Website.

1. Description of the purchase procedure

The procedure for contracting the products offered through the website is the following one:

Select the product: The user who wishes to purchase a product offered through the website must click on the "Buy/Purchase" button. Before clicking it, the user may consult the detailed description of the product that he/she is interested to purchase. The member may continue with the purchase process until they have selected all the products they wish to request through the website.

Purchase Confirmation: Once all the products have been selected, the user will be able to see the selected products where a summary of the order will be shown. If you wish to continue shopping, you must click on the "Continue shopping" button. Otherwise, it will mark the “Pay” button.

Identification: the user must identify himself/herself as a member. If you are not part of ESTRELLA, you can register to continue shopping.

My basket/Shipping data: In next step, the User must fill out a specific form related to the shipment of the order. The user who had already registered their shipping data at a previous time should not fill in this information again. Otherwise, before confirming the payment information, it is necessary to include the order shipping information, as well as the billing information. Once this information is completed, you can click the "Review the order" button.

Customer data and secure payment: The user must fill out a specific form related to the shipment of the order. In next step, the user must choose a payment method between payment by credit card or bank transfer to confirm the order. Before going to the next one, the user can, before validating, see a summary of the order. In addition to this, the "Complete Purchase" button must be marked and the user will be redirected to the payment platform that corresponds to the chosen payment option.

Payment confirmation: once the order is confirmed, the confirmation of receipt of the order is shown to the user. The order will be processed once ESTRELLA receives the confirmation of the payment of the order according to the preferred option in the "Customer data and secure payment" step. The user can continue buying once this purchase process is finished.

Once the purchase process has been completed, the user will receive an email with the information related to the order (order number, products that have been purchased, delivery time and information on shipping costs).

2. Shipping conditions

ESTRELLA sends its products exclusively to Spain. Transport costs, depending on the shipping area of the products, will be paid by the buyer. These shipping costs vary depending on the shipping area and the total weight of the order.

From €99 of purchase, ESTRELLA will not invoice shipping costs for delivery to any address in mainland Spain.

From €199 of purchase, ESTRELLA will not invoice shipping costs for delivery to any address in Baleares Islands

The delivery of the orders will be made at the delivery address that can be indicated by the user, within the period established in the product file itself. ESTRELLA has contracted with its logistics partner the possibility of a second delivery attempt, at no additional cost and that it can be coordinated with the user, in case that the user is not at the shipping address on the first delivery attempt. However, ESTRELLA will not assume any responsibility when the delivery of the product does not take place as a result of the inaccuracy or falsity of the data provided by the user for this purpose. Also, there will not be any responsability in case that the delivery can not be made due to reasons beyond our control, as it can happens in the absence of the recipient in the two delivery attempts which have been set out in the contracting conditions.

ESTRELLA can not be held responsible for delays in the delivery of orders for reasons not directly attributable to ESTRELLA, nor for reasons beyond the company's control, such as unforeseen circumstances and force majeure.

3. Price of the products that are offered in ESTRELLA

The price of the products that are offered on the website include, unless it can be expressly indicated, the Value Added Tax (VAT) or other taxes that may be applicable and, in any case, will be expressed in the Euro currency (€).

For any information about the order placed, the user may send an email to store@estrelladecastilla.es. In any case, it must be mentioned the order number that was assigned in the purchase confirmation by email.

4. Right of withdrawal

You have the right to withdraw from this contract within a period of 14 calendar days without justification. The withdrawal period will expire 14 calendar days from the end of the contract. TELEPHONE 923-15-80-40, and eMail: store@estrelladecastilla.es, your decision to withdraw from the contract through an unequivocal statement.

It is excluded from this right the products purchased that come from fresh meat, the sliced ones that are opened or any other that is delivered sealed and whose seal is removed, as well as those that expire quickly or that are directly excluded in the article 103 of the Consumer Law.

You can use the withdrawal form model that appears below, although its use is not mandatory, being able to use any other unequivocal statement. If you choose fro this last option, we will notify you without delay in a durable medium (for example, by email) the receipt of the mentioned withdrawal. To comply with the withdrawal period, it is enough that the communication regarding the exercise by you of the right of withdrawal is sent before the withdrawal period expires.

Consequences of the withdrawal:
In case of withdrawal on your part, we will refund all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method instead of the least expensive one that we offer) without undue delay. This issue will be managed no later than 14 days from the date on which we are informed of your decision to withdraw from this contract. We will proceed to make the refund using the same means of payment that was used by you for the initial transaction. We may withhold the reimbursement until we have received the goods. You must return or deliver the goods to us without undue delay and, in any case, no later than 14 days from the date on which you notify us of your decision to withdraw from the contract. The deadline will be considered fulfilled if you return the goods before the 14-day period has expired. The merchandise will be delivered with the seals and the packaging without any damaged and in its original packaging. You must bear the direct cost of returning the goods. You will only be responsible for the decrease in value of the goods resulting from handling other than the necessary one to establish the nature, the characteristics and the performing of the goods.

5. Applicable legislation and competent jurisdiction

These general conditions are ruled by the Spanish Law.

If you are contracting as a consumer, for the resolution of possible disputes, the parties agree to submit, at their choice, and waiving any other jurisdiction that may correspond to them, to the courts and tribunals of the city corresponding to the address of the member or user .

If you are contracting as a company, the parties agree to submit to the Courts and Tribunals of Salamanca, expressly waiving their own jurisdiction if they had it.
